These are the Terms & Conditions for booking a photo booth with U Got Snapped Photobooth.
1. Definitions
U Got Snapped Photobooth: U Got Snapped Photobooth Pty Ltd (ABN: 83712962338)
Client: The person, organisation, company or other body which is hiring the goods as specified on the Booking Form.
Booking Form: The form signed by, or on behalf of, the client and U Got Snapped Photobooth specifying details of the booking.
Booking Confirmation: The confirmation sent to the client in writing by U Got Snapped Photobooth, headed, “Booking Confirmation”, confirming details of the booking.
Event date: The time and date of the event, confirmed by U Got Snapped Photobooth and noted on the Booking Form.
Day: A calendar day, unless specified otherwise.
Venue: The location or address where the goods will be delivered, set up and picked up.
Equipment: The Photo Booth booked by the client, as noted on the Booking Form and confirmed by U Got Snapped Photobooth.
Booking Cost: The total fee for hiring the equipment, as noted on the Booking Form and confirmed by U Got Snapped Photobooth.

2. Booking confirmation
2.1. A booking is not confirmed until the client returns a Booking Form, pays any costs as outlined under ‘Payments’ in these terms and conditions, and receives confirmation of the booking from U Got Snapped Photobooth.
3. Payments
3.1.Prices are subject to change - please check before booking for current rates
3.2.An additional travel surcharge may apply to events outside the Sydney Metropolitan region
3.3. Bank deposit (EFT) or Cash are our only acceptable methods of payment
3.4. A non-refundable deposit of $300 of the booking cost is payable upon booking. The booking is not confirmed until the deposit is received by U Got Snapped Photobooth. If we are unable to provide our service upon you leaving a booking deposit, we will notify you and issue you a refund. There will be a non-refundable 2.5% fee withheld from your booking amount due to our third party provider withholding this fee as part of processing the refund via our online booking system. This fee is not refundable by the third party provider therefore we are unable to refund this fee to you.
3.5. The balance of the booking cost is payable at least 15 days before the client’s event.
3.6. If the balance of the booking cost is not received at least 15 days before the event date, the booking will be cancelled and the client will forfeit the deposit.
3.7. If on the Event Date, the client requests use of U Got Snapped Photobooth's services in excess of the time noted on the Booking Form , this will be billed at $200 for each additional hour or part-hour.
4. Access, space & power requirements
4.1. The client shall ensure a safe and appropriate environment is provided for U Got Snapped Photobooth to operate its equipment.
4.2. The client must ensure:
– a space of 2.5m x 2.5m or more.
– access to 240v power within 10m of U Got Snapped Photobooth’s equipment.
– all doorways and access paths are at least 80cm wide.
– if an outdoor event, an undercover area if any chance of poor weather.
4.4. The client is responsible for paying any charges imposed by the venue, or required to access the venue. These charges may include, but are not limited to, parking and electricity.
5. Changes & cancellations
5.1. Requests for changes of the event date must be made at least 30 days before the original event date. A date change is subject to availability and receipt of a new Booking Form.
5.2. All cancellations will result in the client forfeiting the deposit.
5.3 If U Got Snapped Photobooth is notified of cancellation more than 30 days before the event date, credit to the value of the deposit will be given to the client to use for any future booking made within 6 months of the date of cancellation, however, U Got Snapped Photobooth is under no obligation to do so and any future booking is subject to availability.
5.4. Cancellations made within 30 days of the event date will result in the client forfeiting all payments already made to U Got Snapped Photobooth.
5.5. U Got Snapped Photobooth can cancel any booking at any time. If U Got Snapped Photobooth decides to cancel a booking, except if pursuant to clause 3.6 or as a result of client’s breach of any terms and conditions of hire, payments already made will be refunded to the Client. In this case, we will issue you a refund of 97.5% of your total booking amount. There will be a non-refundable 2.5% fee withheld from your booking amount due to our third party provider withholding this fee as part of processing the refund via our online booking system. This fee is not refundable by the third party provider therefore we are unable to refund this fee to you.
6. Damage to equipment
6.1. In order to prevent damage to equipment, U Got Snapped Photobooth reserves the right to deny service to any person.
6.2. If circumstances arise where a threat or implied threat of harm, damage or violence to U Got Snapped Photobooth’s staff or equipment, U Got Snapped Photobooth reserves the right to cease providing services. If the client is able to resolve the threatening situation within 20 minutes, U Got Snapped Photobooth will resume services. If the situation is unable to be resolved within 20 minutes, U Got Snapped Photobooth will not resume providing service and the client will receive no refund of booking cost.
6.3. Any damage to U Got Snapped Photobooth’s equipment during the client’s event caused by the client, client’s guests or any other person in attendance at the event whether invited or not, will result in the client paying the costs to repair/replace the equipment within seven (7) days of the client receiving written notice from the owner.
7. Use of images
7.1. The client gives permission for all photos taken during the event to be used on U Got Snapped Photobooth’s website and other promotional material.
7.2. The client acknowledges that U Got Snapped Photobooth takes no responsibility for people obtaining copies of the photos and videos from the website or social network site.
8. Force Majeure
8.1. U Got Snapped Photobooth will not be held responsible for non-performance of the agreement or any loss arising due to any circumstances outside their control. This includes, but is not limited to, fire, riot, civil commotion, accidents, acts of nature, natural disaster, threatened or actual act of terrorism, war, emergencies and non-emergencies.
9. Operation, Maintenance and Storage of goods
9.1.The client agrees that it is their obligation to inspect and check to satisfy itself that the equipment is in good order and condition at the time of delivery.
9.2. The client acknowledges that they have proper knowledge in the operation of the equipment and warrants that it will operate the equipment with due care and diligence and in compliance with the instructions and recommendations of U Got Snapped Photobooth, and will indemnify for any breach of the warranty hereby given.
9.3. The client undertakes that the equipment will remain at all times under the client’s control and that the photobooth will be kept at the venue for the duration of the hire and undertakes that the equipment will not be removed from the venue in any circumstance.
9.4. The client agrees that a responsible adult over 18 years of age needs to be present at all times on the venue for the duration that the equipment is hired by the client.
9.4. The client agrees that children under 12 years of age must be supervised by a responsible adult at all times when using the photobooth.
9.5. The client agrees that U Got Snapped Photobooth will not be liable for any loss arising from equipment failure. If the equipment failure is due to mechanical or electrical failure (not including failure of main power supply or any malfunction caused by the client or any other person not following the operational procedures), all reasonable efforts will be made by U Got Snapped Photobooth to provide service or find a suitable replacement service. If this is not possible, the client will receive a refund of payments received by U Got Snapped Photobooth for the booking. In this case, we will issue you a refund of 97.5% of your total booking amount. There will be a non-refundable 2.5% fee withheld from your booking amount due to our third party provider withholding this fee as part of processing the refund via our online booking system. This fee is not refundable by the third party provider therefore we are unable to refund this fee to you.
10. Risk and Insurance
10.1. The rights of the client to use and take possession of the equipment are as bailee only. The ownership of the equipment remains with U Got Snapped Photobooth.
10.2. The client accepts full responsibility for the equipment for the duration of hire and whilst in their possession.
10.3. The client is liable for any loss, damage to property, injuries to or death of persons, howsoever arising whilst the equipment is in their possession or being used by the client.
10.4. The client indemnifies U Got Snapped Photobooth against the loss of or damage to the equipment, whether by fire, theft, accident, seizure, confiscation, malicious damage or otherwise and hold U Got Snapped Photobooth harmless from all other losses, damages, claims, penalties, liabilities and expenses (including legal costs) howsoever arising incurred as a result of or in connection with the equipment or the possession or use of the equipment by the client.
11. Indemnification
11.1. The client agrees that in all circumstances, U Got Snapped Photobooth’s liability is limited to an amount equal to the booking cost and not be liable for indirect or consequential damages.
12. Variation
12.1. U Got Snapped Photobooth may vary the “Terms and Conditions of Hire” at any time by updating its website. The client should visit the website from time to time and review the current “Terms and Conditions of Hire” because they are legally binding on the client.
12.2. Any variation of the terms and conditions of the Agreement can only be made by written confirmation from U Got Snapped Photobooth.
13. Waiver
13.1. No failure of U Got Snapped Photobooth to exercise or enforce any terms and conditions or its rights shall act or be construed as a waiver of subsequent breaches.
14. Severability
14.1. In the event any term or condition of hire is held by a court or tribunal to be unenforceable, that term or condition will be enforced to the maximum extent permissible under applicable law, and other terms and conditions of the Agreement will remain in full force and effect. The parties further agree that in the event such term or condition of hire is an essential part of the Agreement, they will begin negotiations for a suitable replacement provision.
15. Entire Agreement
15.1. The “Terms and Conditions of Hire” in this document, the Booking Form and Booking Confirmation constitutes the entire agreement between the parties and replaces all representations or proposals not contained in these documents.
15.2. In the case there is inconsistency between the Booking Form and Booking Confirmation, the terms and conditions in the Booking Confirmation prevails to the extent of the inconsistency. It is the client’s responsibility to ensure the accuracy of the Booking Details and the client must inform U Got Snapped Photobooth immediately of any inconsistency.
16. Idle time
U Got Snapped Photobooth is responsible for the delivery, setup, breakdown, and maintenance of the photo booth during the scheduled rental. Rental hours are counted as consecutive hours with no breaks in run-time. Breaks in the run-time of the photo booth are considered idle time and will be an additional charge at the idle hour rate. We will arrive 2 hours prior to the rental to setup the photo booth. We can arrive earlier to setup or dissemble the photo booth at a later time at the charge of "idle hours". The rate of idle hours is $50 per hour.
